I'm still receiving phone calls from my providers looking for payment and wanting to know when or if I can send them money. Also received a letter from pinnacle health wanting me to apply for finacial assistance. Even though i sent them that letter from the Union ATT. stating that if they have questions to contact them, but I'm still getting the calls and the letters. So what good did it do for me to waste my time and money on stamps to send them this letter from the ATT. Mike Healey ?

As of today no one has received any payments or notice of when or if they will be paid. Hopefully MRMRB you qualify for chip program for your kid. I called Mr. Healey and he said: he would call me back, that was 3 weeks ago and I still havent heard a word back from him. Kinda like T.A.D returning calls to the bill collectors. Think we have a better chance of hitting the lottery,than ever seeing the end of this hopeless situation.

I have been monitoring this forum quite often and I have a few questions:

1.  Is TAD 3 or four weeks behind in hourly payroll?  If so, are they also behind in upper managements payroll?  I would be willing to bet Anne Richey and Mr. Frazier are getting ther pay on time!

2.  Are the proper authorities letting this injustice die out or are they in fact investigating anything?

3.  Is it true that there is absolutely nobody on site, so did they decided to close the doors?

4.  Whether or not they are closing the doors is not revealent.  Just how long are the local, state, and federal authorities going to allow them to continue to financially ruin people's lives with out paying a penalty?

5.  Will they be made to pay these outstanding medical bills and payrolls or not?

If they do not pay the employees outstanding medical bills, then Mr. Walton shouId be made penneyless!  I wonder, if the justice system would be acting a lot quicker if an employee told an insurance company lies in order to make money.  Isn't Governor Rendell pushing T.V. ads against insurance fraud or is "Corporate America" immune from these laws?

It just seems to me at this time there is no justice for all anymore.  I am hearing from several sources about other companies pulling the same stunts.  I sincerely hope the legal system does in fact catch up with these people and all the other companies that are using the same shady tactics.  I strongley think the justice system needs to clean up "Corporate America" in a big way!

Your post brought a tear to my eye. I am so sorry to hear about the passing of your father; my condolences to you and your family. How sickening is it that TAD upper management has failed to pay, not only the employee’s health insurance premiums, but their life insurance premiums as well. Here your mother was expecting that policy to be active and in force, only to discover that those rotten thieves failed to pay the life insurance premiums with the deductions they withheld from paychecks. Now your mother is stuck with the bills, including those unpaid for health insurance. May all in TAD upper management rot in hell!!!

In following the terrible situation at TAD, I have come to recognize the callous, inhumane, and greedy nature of their upper management personnel. It is sickening to witness how they treat their workers. They have no regard for the health, welfare, and stability of any employees during work hours or in situations outside the plant.

Hopefully, you will consider suing TAD for damages, including punitive damages meant to punish them. There are many good attorneys in the Harrisburg area. If you explain the circumstances surrounding the death of your father, an attorney will take your case on a contingency basis and not charge you for anything; payment will be deducted at the final judgment and settlement of your case. It would be logical to conclude that the failure of TAD to make health coverage payments, which resulted in the delay of any treatment your father had expected to receive, was a contributing factor in his death, thus making TAD liable for damages. If you do intend to sue them (be sure to name John A. Walton in the lawsuit), please do not wait too long. In the near future they will be going out of business, filing for bankruptcy, and abandoning the plant.

Also, please do not be discouraged if an attorney tells you that your case against the company lacks merit or legal grounds, or is unwinnable. There are numerous reasons why a lawyer will refuse to take a case; in addition, there are reasons why a lawyer might not disclose the truth about a case rejection. I guarantee you, there have been plaintiffs in the past that initiated civil lawsuits, but were told previous to the complaint filing by several different attorneys from different law firms they would not take the case—for various reasons. These plaintiffs were committed to their cause, convinced of the legitimacy of their case, refused to give up their fight for justice, and refused to take “no” for an answer. They eventually found a good lawyer to represent them and then formally proceeded against the defendants. Please do not quit seeking legal counsel even if you are turned down by several attorneys.

My best wishes to you no matter what you decide to do.

Thomas Gardner!!!

I was informed by a TAD employee that several weeks ago you, Tom Gardner, acted inappropriately toward one of their co-workers. The employee stated essentially that YOU ACCUSED THAT INDIVIDUAL OF POSTING DETRIMENTAL INFORMATION IN THIS FORUM; YOU CLAIMED TO KNOW THAT INDIVIDUAL'S IDENTITY WHEN POSTING IN THIS FORUM; YOU CALLED THAT WORKER A "LIAR" TO THEIR FACE AFTER THEY DENIED THE ALLEGATIONS; YOU THREATENED THAT EMPLOYEE WITH TERMINATION; AND THAT YOU AGGRESSIVELY "STARED DOWN" AND "SCOWLED" AT THE WORKER FOR A LONG TIME DURING A LUNCH BREAK.

Where do I begin with this! First of all, I hope that worker referred to filed several grievances against you for your outrageous, despicable, unproductive, and asinine behavior!!! Here is more proof or what a jerk you really are!!!!!

***To the aggrieved worker (I am hoping the following truncated information was previously forwarded to you as I do not have your contact information and have not heard back from the fellow employee who alerted me about your conflict with Gardner.):

If you haven’t already, PLEASE FILE GRIEVANCES AGAINST THAT PUNK, THOMAS GARDNER!!!!! I realize you probably will not have much success considering the failures of your union at TAD and because upper management essentially dictates things to the union, but at least you will get his inappropriate actions documented for possible future counter-action on your part. REMINDER: IF THE UNION FAILS TO PROPERLY REPRESENT YOU AND DEFEND YOU AGAINST THIS FOOL, YOU CAN FILE A COMPLAINT AGAINST THE UNION WITH THE NATIONAL LABOR RELATIONS BOARD (NLRB).

There are several grievances you can file against Gardner. They include a grievance for falsely accusing you of posting detrimental information (which I know he lacks proof thereof); for his speculative assertion that you were identified (which there is no way he can possibly know for sure, had to be based on hearsay evidence, and ultimately lacks merit); for his unfounded verbal attack on your character by calling you a liar (which is slander); for his unreasonable and illegal threat of dismissal (which would constitute an unjust termination); for his repeated engaging of bullying and strong-armed scare tactics (which represents intimidation and harassment). If you are still working for that jerk, you have my utmost respect. Quite frankly, I do not know how you could perform your job functions under the working conditions Gardner has exposed you to.

I take it by your message that you are a former creditor who TAD management defaulted on. Unfortunately, get in line to get paid; TAD HAS, AND WILL CONTINUE, TO DEFAULT ON PAYMENTS TO THEIR CREDITORS. THEY DISRESPECT THE SERVICES OUTSIDE SOURCES PROVIDE AND LAUGH AT SUPPLIERS, VENDORS, AND THE LIKE, BECAUSE THEY (TAD MANAGEMENT) KNOW THAT THEY CAN SIMPLY GO ELSEWHERE TO ACQUIRE WHATEVER SUPPORTIVE ITEMS THEY NEED! ARROGANT BASTARDS!!!!!

Like other creditors that the criminals in TAD management have defaulted on, I believe you will need to seek a remedy by taking legal action against them in court. If their total defaulted payment is under $5000 you can sue them in small claims court. (I think Pennsylvania has a $5000 limit--might need to check on that.) I believe the filing fee for small claims court is $35, but I could be off on that figure; please check with the courthouse. You do not need an attorney to sue TAD in small claims court. You can obtain current information by calling the courthouse; they will answer your questions and direct you to the proper bureau. If the amount of payments TAD defaulted on was more than $5000, you will need to file a lawsuit against them in a higher court. For that, depending on the amount you are seeking, you might want to consider hiring an attorney.

As far as I know, legal action is the only recourse to remedy your situation. If you decide to sue TAD in court, please let Samica Knight and CBS 21 News know about it. Samica and the news team have been instrumental in helping TAD employees by bringing the injustice done to them into the forefront and in the public eye. Your situation is just one more transgression in a series of transgressions perpetrated by TAD management needing to be exposed. The news crew has yet to do a story on all of the suppliers, vendors, and creditors TAD management has committed a fraud against. Hopefully, that segment of this tragic plight will be reported on as well. If you do take legal action against TAD and a story is run on the creditors they stole from, that will help other creditors who are in a similar position as you are by alerting them to the improper business practices of TAD management as well as a course of action to take against them.

I think you are right. It is ashame you will have to spend yet more of your own money to try and get what belongs to you in the first place. 

Unemployment is nearing the end for most of us and not many companies are hiring.

I am tired of hearing on the news about the state workers not being paid. I thought it was only temporary and that they will get what is owed to them? Well how about TAD employees who will probably never see another dime of what was owed to them as well as what was stolen from them?Rediculous.
